Warranty vs Fluids (in particular DCT threads of late)

This is branch off from a related thread ...
    https://www.mercedescla.org/forum/64...-2014-a-2.html

    Benz specifically states:
"damages that occur due to the usage of non-approved operating fluids are not covered by the warranty"

Our friends at Amsoil remind us of a few good points on their site:
    - It is illegal to tie warranty coverage to whichever brand of parts or lubricants you use. Manufacturers that do so must provide the parts or lubricants free of charge.
    - You have the freedom to choose how you protect your vehicles and equipment, including use of products formulated for extended drain intervals.
    - Manufacturers can’t deny warranty coverage without showing the aftermarket part or lubricant caused a failure.

Motor oil is less of an issue as even Benz themselves offer enough market choices in their BeVo listings so if a nut is stupid enough to use 2-cycle weed wacker oil in their engine why then Benz prevails.
However in OUR particular case for the CLA, there are ONLY 2 listings for DCT fluids (one Shell, one Benz, which are most probably the same darn thing) so now things get funny, e.g. say one uses Fuchs or Pentosin which "claim" to satisfy BeVo 236.21 ... and upon fluid change the gearbox dies or hiccups or gets wonky and needs to be fixed/replaced.

Now I wonder ... does the obvious language conflict affect us ? i.e. which one supersedes ? will Benz win ?

*** Mikey @JustSynthetic.com : if you see this, chime in from Amsoil's warranty point of view ***

    Feel Secure Using AMSOIL Lubricants
    Warranty Secure logo
You can be confident that using AMSOIL synthetic lubricants or practicing extended drain intervals does not void your new vehicle or equipment manufacturer's warranty. In addition, all AMSOIL lubricants and filters are covered by the AMSOIL Limited Warranty.

    The Magnuson-Moss Warranty Act

It is against Federal law for an original equipment manufacturer (OEM) to deny warranty coverage based solely on the brand of lubricant used. The Warranty Secure symbol informs consumers of this fact. Using AMSOIL synthetic lubricants in place of OEM-branded lubricants, or practicing extended drain intervals when using AMSOIL lubricants, does not void new vehicle or equipment manufacturer warranties.

According to the Federal Trade Commission:

The Magnuson-Moss Warranty Act makes it illegal for companies to void your warranty or deny coverage under the warranty simply because you used an aftermarket or recycled part.... The manufacturer or dealer must show that the aftermarket or recycled part caused the need for repairs before denying warranty coverage. (http://www.ftc.gov/bcp/edu/pubs/cons...ts/alt192.shtm)

AMSOIL stands behind its products and the people who use them. If the OEM claims use of AMSOIL products violates the warranty, contact AMSOIL Technical Services (715-399-TECH).
